But from what I know, such employers just open up another company, not in their name, but their spouse or sibling or such and operate behind the scenes until its safe to come out. Other strategies they employ, send payment checks to employees old address on file knowing for sure that its gonna come back thereby delaying the process more.
The other side to the coin is that many times benching is an unholy marriage of convenience between the employer and employee. Employee does not want to go back and does not want H1 revoked and stickes a deal with employer. So its not always the employer at fault.

When you submit your passport for renewal, they usually give you a receipt with pickup date. This date is anywhere between 2 weeks to 6 weeks.
If you want you can request them to mail your new passport by paying extra $15 for mailing.
If you are going to pickup the passport by person, then you should be there between 4PM-5:15PM. Thats the delivery time.
In DC office you can not pickup anything before 2PM. Remember this

What I am worried is that even if I drive 5 hours to pick up, if they haven't processed my application (its close to 4 weeks now since I have applied), I will run out of options. On the website they claim that they will process in 5 business days. I must have tried close to 5 different phone numbers multiples times for past week or so. I have also emailed and faxed my query multiple times. Same result - No response at all. I just don't get how work is done at the embassy.

I read now about Direct Filing....and I understood that if you apply after july 30...you can send the application either to Nebraska or Texas. Hopefully I'm right in this matter.

I am in the same boat. No 485 receipts for me or my wife. Got EAD and AP receipts only for myself. 485 filled at NSC on July 2nd. EAD and AP also filled at NSC but on Aug 15, 2007. I think NSC is still data entering July 2nd cases.

There is no 180 days wait period for derivatives. For you to change jobs, you need to wait 180 days to use AC21, but for the dependents, they can do whatever they want and whenever they want after they receive EAD card. It is like GC for them, but only difference is they need to renew EAD every year unlike GC. Otherthan that it is all fine as long you maintain your AOS status properly.

This is really what Obama's advisors should read. Employers cannot find qualified employees to even fill these great job openings (with unemployment rate nearing 10%). America is loosing already and will keep on loosing if immigrant workers do not take up these jobs to keep US competitive.

What you think , doesn't matter.
Cant fly through FRANCE/UK for sure, without a valid US visa stamped.
People had issues even with Lufthansa, but as per law on the German Consulate , a person should be able to transit through Germany. But i would avoid it.
Emirates/Direct AI/Continental should be OK from East Coast.
Alright. I did not realize that this was a case of no valid visa on passport. I cannot attest to that.

I spoke to the US mission- they dont have information yet about the process change for people who want to take appointments after 1st of Sept.
However people who have already taken appointments prior to Sept 1 are not subject to any change. They need to show up with a reciept the day of the interview as before.

Can you please reaffirm that we ought to file extension based on April 16, 2010 and not May-01-2011.

To elaborate on that, S.Korea happens to be on the forefront of technological innovations. Highest per capita broadband use, highest per capita cellphone use...land of samsung and Hyundai

I applied I-485 in July 2007. But didn't apply for EAD/AP. I applied for EAD for the first time now, few days back and I was asked by my lawyer a check of $340 as application fee.

Yes you can fedex the AP to india and yes she can use it while coming back if needed. I got this from USCIS level 2 immigration officer.:D

I work and live in CA. My employer is also in CA and we are July 2nd filers. Our 485 got transferred to TSC and then we received this letter stating that TSC has completed the initial processing and transferred it to the local office in Lincoln,NE. It also mentioned that they might schedule an interview if needed. This was about 4 months back and nothing again after that.

Hello all,
Could someone who are recently travelled via London Heathrow, please let me know what all should be done in order to obtain the DATV visa?
My flight stops there for under 2 hours (for cleaning and refuelling), and I was told I need to get the DATV since my visa expired and my approved AP alone is not enough.
Though I have gone through the required websites, i would still appreciate info from any one who recently experienced getting the DATV and travelling via London. Do I need to send I-485 receipt notice original and EAD as well?
Or is it enought to send the online application, passport, photo and AP originals?
Is there anyway to do everything in person, including handing over documents?
Also, it would be great if you could let me know how long it took to get the visa and your documents back!
Any help is GREATLY appreciated!

I understand the pain beacuse of these RFE as we all are waiting for our GC.
There is no need to worry about these kind of RFEs. Just like and RFE asking for latest empolyment verfication letters and W2s, this RFE for Marrige proofs is also similar.
As there is a possibility of the couple getting divorced, USCIS wants to make sure, the couple are still married during the entire process time of their GCs.
It doesn't mean that, in every one's case, they send this RFE, It's just Random.
And in case, if any one of the couple, sends any information to USCIS that they are not living together and a chance of getting divorced, then in those cases, USCIS sends the RFE.
But in most other cases, it's just Random. We have to reply to that RFE with the documents such as, the Marriage certificate, any documents to show that you are still married and living together, like, any Bank statements with Joint accounts, Birth certificates of the recent kids born to the couple etc.
