Hi Readers,
My fiance has a (U.S) MS degree in Chemistry but has been working on H1b as a computer programmer for the last 2 years ? All her undergraduate work has also been in the Sciences. Her GC sponsor is a software company and she will be applying as a computer programmer. Does anyone have experience with this kind of Labor Certification situation ? Thank you for any help.

Hello,
I am from India and currently visiting USA on B2 visa. I recently got a job with a very reputed firm in US and applied for an H1B but my application reached USCIS after the H1B quota was full.
I really want to work for my new employer and would like to know what other options do I have to obtain work permit in USA other than L1 Visa?

If it is a non profit research org or institute of higher education then H1 will not be counted towards quota. On the other hand if you have the credentials you can try for "O" VISA

We have been applying for advance parole document at NSC for the last few years.
This time we sent our application to NSC on 01/28/2010.
After about 15 days, we received a receipt notice letter from Vermont service center.
The I-131 application instructions specify that I-140 based applications should be sent to either Nebraska or Texas service centers.
I am wondering if USCIS started processing I-131 application in VSC.
Or our application is mistakenly misclassified and sent to VSC.
Any comments?

My employer has been holding back my wages on some excuse or the other. Since I was awaiting my GC, I had no choice but co-operated with them. I got my GC last year in July 2010. I worked with them until September 2010 and due to this payment situation, I have chosen to work elsewhere.Now they promise to pay the back wages from 2010 but the payment never arrives. Repeated followups, emails and calls have yielded the same result. I am not sure what are my options here at this point. I no longer work for that Employer since they never pay on time.

There is no such deadline. But it would do you good to file them before July 31st or other wise it might retrogress.

Guys,
Please help me...I do not have much knowledge about GC process. I am working on H1B visa from last 3 years with my current employer and they are ready to apply for GC but, I know that for GC in the same position I cannot use the experience gained during past 3 years. But if I apply for GC for the next level (as GC is for future employment) with the current experience and keep working in my current role until my GC is approved, do you guys see any problem with that? GC approval will easily take 4-5 years and during this time I can keep working in my current position and once GC is approved I can switch to the next level which is kind of promotion.

My lawyer selected option "a" in section 2 of I-485 for I-140/I-485 filed concurrently. Some members are saying that their lawyer selected option "h". Can some one tell me what must be the correct option for concurrent filing? If option h is correct, Is it possible to amend the existing petition?
